Az Eur\u00f3pai Bizotts\u00e1g szerint a magyar szab\u00e1lyoz\u00e1s s\u00e9rti az EU \u00c1fa Ir\u00e1nyelv\u00e9nek 183. cikk\u00e9t. Az Eur\u00f3pai Bizotts\u00e1g m\u00e9g 2010. m\u00e1rcius 18-\u00e1n kiadott egy k\u00f6zlem\u00e9nyt, hogy miut\u00e1n Magyarorsz\u00e1g nem tett eleget az ezzel kapcsolatos felsz\u00f3l\u00edt\u00e1snak, a Bizotts\u00e1g k\u00e9nytelen az Eur\u00f3pai B\u00edr\u00f3s\u00e1g el\u0151tt megt\u00e1madni magyar \u00c1fa t\u00f6rv\u00e9ny azon rendelkez\u00e9seit, amely tiltja, hogy az ad\u00f3alany\u00a0beszerz\u00e9sei ut\u00e1n\u00a0visszaig\u00e9nyelhesse az el\u0151zetesen felsz\u00e1m\u00edtott \u00e1fa azon \u00f6sszeg\u00e9t, amelynek ellen\u00e9rt\u00e9k\u00e9t m\u00e9g nem fizette ki. Ha az Eur\u00f3pai B\u00edr\u00f3s\u00e1g a Bizotts\u00e1gnak ad igazat, \u00fagy a magyar Korm\u00e1ny k\u00e9nytelen lesz kivenni a rendszerb\u0151l azt a f\u00e9ket, hogy csak akkor adja vissza \u00e1f\u00e1t az \u00e1llam, ha azt m\u00e1r valaki kor\u00e1bban befizette.<\/p>\n

Ez a v\u00e1ltoztat\u00e1s komoly hi\u00e1nyt keletkeztethet a k\u00f6lts\u00e9gvet\u00e9sben, egyes becsl\u00e9sek sz\u00e1zmilli\u00e1rd forintos \u00f6sszegekr\u0151l sz\u00f3lnak (term\u00e9szetesen ez csak \u00e1tfut\u00f3 t\u00e9tel, de \u00e9vek k\u00f6z\u00f6tti \u00e1th\u00faz\u00f3d\u00f3 t\u00e9telek miatt komoly elt\u00e9r\u00e9st okozhat a k\u00f6lts\u00e9gvet\u00e9si hi\u00e1nyban is). A magyar indokl\u00e1s szerint term\u00e9szetesen sz\u00fcks\u00e9g van a jelenlegi rendszer fenntart\u00e1s\u00e1ra, hiszen ez egy j\u00f3 m\u00f3dja az \u00e1fa-csal\u00e1sok kisz\u0171r\u00e9s\u00e9nek. Ez ut\u00f3bbira azonban alternat\u00edva lehet a ford\u00edtott ad\u00f3z\u00e1s kiterjeszt\u00e9se is \u2013 vagyis annak kellene az \u00e1f\u00e1t befizetnie, aki a visszaig\u00e9nyl\u00e9sre is jogosult \u2013, de ez a m\u00f3dszer is ugyanolyan likvidit\u00e1si vesztes\u00e9get jelent az \u00e1llamnak.<\/p>\n
