Az \u00faj rendelkez\u00e9seket \u2013 f\u0151szab\u00e1lyk\u00e9nt \u2013 a m\u00e1r fenn\u00e1ll\u00f3 munkaviszonyokra is alkalmazni kell.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A v\u00e1ltoz\u00e1sok egy r\u00e9sze a munkaszerz\u0151d\u00e9s tartalm\u00e1t \u00e9s a munk\u00e1ltat\u00f3 \u00e1ltal kiadand\u00f3 t\u00e1j\u00e9koztat\u00f3t \u00e9rinti.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A j\u00f6v\u0151ben, ha a munkaszerz\u0151d\u00e9s m\u00e1sk\u00e9nt nem rendelkezik, akkor a munkaviszony a szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9t k\u00f6vet\u0151 napon kezd\u0151dik \u00e9s hat\u00e1rozatlan id\u0151re j\u00f6n l\u00e9tre, illetve munkahelynek a munkak\u00f6rben szok\u00e1sos munkav\u00e9gz\u00e9si helyet kell tekinteni. Tov\u00e1bb\u00e1, ha a munkaszerz\u0151d\u00e9s nem \u00edr el\u0151 elt\u00e9r\u0151 napot, \u00fagy a munkaviszony a szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9t k\u00f6vet\u0151 napon kezd\u0151dik.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jelent\u0151sen kib\u0151v\u00fcl a munk\u00e1ltat\u00f3 t\u00e1j\u00e9koztat\u00e1si k\u00f6telezetts\u00e9g\u00e9nek k\u00f6re, amelynek hat\u00e1rideje a kor\u00e1bbi 15 nap helyett 7 nap lesz.\u00a0A t\u00e1j\u00e9koztat\u00e1sban szerepelnie kell sz\u00e1mos olyan \u00faj elemnek, mint p\u00e9ld\u00e1ul:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a munkahely megjel\u00f6l\u00e9se,<\/li>\n\n\n\n<li>a napi munkaid\u0151 tartama,<\/li>\n\n\n\n<li>a h\u00e9t azon napjainak felsorol\u00e1sa, amelyekre munkaid\u0151 oszthat\u00f3 be,<\/li>\n\n\n\n<li>a beoszt\u00e1s szerinti napi munkaid\u0151 lehets\u00e9ges kezd\u0151- \u00e9s befejez\u0151 id\u0151pontja,<\/li>\n\n\n\n<li>a rendk\u00edv\u00fcli munkaid\u0151 lehets\u00e9ges tartama,<\/li>\n\n\n\n<li>a munk\u00e1ltat\u00f3 tev\u00e9kenys\u00e9g\u00e9nek saj\u00e1tos jellege,<\/li>\n\n\n\n<li>a munk\u00e1ltat\u00f3 k\u00e9pz\u00e9si politik\u00e1ja,<\/li>\n\n\n\n<li>a munkav\u00e1llal\u00f3 \u00e1ltal ig\u00e9nybe vehet\u0151 k\u00e9pz\u00e9sre ford\u00edthat\u00f3 id\u0151 tartama,<\/li>\n\n\n\n<li>a hat\u00f3s\u00e1g megnevez\u00e9se, amely r\u00e9sz\u00e9re a k\u00f6zterheket megfizetik.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A v\u00e1ltoz\u00e1sok m\u00e1sik csoportja a napi HR feladatok teljes\u00edt\u00e9s\u00e9re hat ki, \u00e9s a munk\u00e1ltat\u00f3k ezir\u00e1ny\u00fa gyakorlat\u00e1nak friss\u00edt\u00e9se, a v\u00e1ltoz\u00e1sokhoz val\u00f3 igaz\u00edt\u00e1sa sz\u00fcks\u00e9ges.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cdgy a j\u00f6v\u0151ben megv\u00e1ltozik a bizony\u00edt\u00e1si teher szab\u00e1lyoz\u00e1sa a joggal val\u00f3 vissza\u00e9l\u00e9s k\u00f6r\u00e9ben: a munkav\u00e1llal\u00f3nak kell bizony\u00edtania a tilalom megs\u00e9rt\u00e9s\u00e9nek alapj\u00e1ul szolg\u00e1l\u00f3 t\u00e9nyt \u00e9s a h\u00e1tr\u00e1nyt, m\u00edg a munk\u00e1ltat\u00f3 bizony\u00edtja, hogy az el\u0151bbi t\u00e9ny \u00e9s h\u00e1tr\u00e1ny k\u00f6z\u00f6tt okozati \u00f6sszef\u00fcgg\u00e9s nem \u00e1ll fenn. Akkor is helyre\u00e1ll\u00edthat\u00f3 lesz a munkaviszony, ha annak megsz\u00fcntet\u00e9se a joggal val\u00f3 vissza\u00e9l\u00e9s tilalm\u00e1ba \u00fctk\u00f6z\u00f6tt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Az azonnali hat\u00e1ly\u00fa felmond\u00e1ssal \u00e9s egy\u00e9b jognyilatkozatokkal kapcsolatban r\u00f6gz\u00edtett\u00e9k, hogy a nyilatkozat \u00e9rv\u00e9nyesen megtettnek min\u0151s\u00fcl, ha a vonatkoz\u00f3 hat\u00e1rid\u0151 utols\u00f3 napj\u00e1n post\u00e1ra adj\u00e1k.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A munk\u00e1ltat\u00f3 szem\u00e9ly\u00e9ben bek\u00f6vetkez\u0151 v\u00e1ltoz\u00e1s (jogut\u00f3dl\u00e1s) eset\u00e9n a munk\u00e1ltat\u00f3 \u00edr\u00e1sbeli t\u00e1j\u00e9koztat\u00e1si k\u00f6telezetts\u00e9g\u00e9nek jelenlegi, az \u00e1tsz\u00e1ll\u00e1st\u00f3l sz\u00e1m\u00edtott 15 napos hat\u00e1rideje az \u00e1tsz\u00e1ll\u00e1s napj\u00e1ra v\u00e1ltozik.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A kor\u00e1bbi szab\u00e1lyoz\u00e1s a munkaviszony teljes\u00edt\u00e9s\u00e9vel \u00f6sszef\u00fcgg\u00e9sben felmer\u00fclt \u201eindokolt\u201d k\u00f6lts\u00e9gek megt\u00e9r\u00edt\u00e9s\u00e9t \u00edrta el\u0151 a munk\u00e1ltat\u00f3nak. A m\u00f3dos\u00edt\u00e1s m\u00e1r a \u201esz\u00fcks\u00e9ges\u201d k\u00f6lts\u00e9gek megt\u00e9r\u00edt\u00e9s\u00e9nek k\u00f6telezetts\u00e9g\u00e9t is el\u0151\u00edrja. B\u00e1r a \u201esz\u00fcks\u00e9ges\u201d fordulatot nem fejtett\u00e9k ki, a m\u00f3dos\u00edt\u00e1s indokol\u00e1sa szerint a munk\u00e1ltat\u00f3knak t\u00e9r\u00edt\u00e9smentesen kell biztos\u00edtaniuk a munkav\u00e1llal\u00f3k sz\u00e1m\u00e1ra a feladataik elv\u00e9gz\u00e9s\u00e9hez sz\u00fcks\u00e9ges \u00f6sszes olyan k\u00e9pz\u00e9st, amelyeket az uni\u00f3s vagy nemzeti jogszab\u00e1lyok, illetve a kollekt\u00edv szerz\u0151d\u00e9sek el\u0151\u00edrnak.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kieg\u00e9sz\u00fclnek a munkav\u00e9gz\u00e9si \u00e9s rendelkez\u00e9sre \u00e1ll\u00e1si k\u00f6telezetts\u00e9g al\u00f3li mentes\u00fcl\u00e9s esetei (pl. \u00e9vente legfeljebb 5 munkanapra mentes\u00fcl a munkav\u00e9gz\u00e9s al\u00f3l a munkav\u00e1llal\u00f3, ha a s\u00falyos eg\u00e9szs\u00e9gi okb\u00f3l gondoz\u00e1sra szorul\u00f3 hozz\u00e1tartoz\u00f3j\u00e1t vagy a munkav\u00e1llal\u00f3val k\u00f6z\u00f6s h\u00e1ztart\u00e1sban \u00e9l\u0151 szem\u00e9lyt szem\u00e9lyesen gondozza).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00daj szab\u00e1lyokaz iktattak be a munkaszerz\u0151d\u00e9s m\u00f3dos\u00edt\u00e1sra vonatkoz\u00f3 aj\u00e1nlat k\u00f6r\u00e9ben. \u00cdgy b\u00e1rmely munkav\u00e1llal\u00f3 &#8211; a munkaviszony els\u0151 6 h\u00f3napj\u00e1t kiv\u00e9ve &#8211; k\u00e9rheti a teljes munkaid\u0151s vagy r\u00e9szmunkaid\u0151s foglalkoztat\u00e1sra \u00e1tt\u00e9r\u00e9st, t\u00e1vmunkav\u00e9gz\u00e9s keret\u00e9ben t\u00f6rt\u00e9n\u0151 foglalkoztat\u00e1st vagy hat\u00e1rozatlan idej\u0171 \u00e1ll\u00e1shelyre val\u00f3 \u00e1thelyez\u00e9st, amennyiben ilyen a munk\u00e1ltat\u00f3 t\u00e1j\u00e9koztat\u00e1sa szerint el\u00e9rhet\u0151. (ld. az Mt. azt m\u00e1r eleve tartalmazza, hogy a munk\u00e1ltat\u00f3 a munkak\u00f6r\u00f6k megjel\u00f6l\u00e9s\u00e9vel t\u00e1j\u00e9koztatja a munkav\u00e1llal\u00f3kat a teljes vagy r\u00e9szmunkaid\u0151s, a t\u00e1vmunkav\u00e9gz\u00e9sre ir\u00e1nyul\u00f3, valamint a hat\u00e1rozatlan idej\u0171 munkaviszony keret\u00e9ben t\u00f6rt\u00e9n\u0151 foglalkoztat\u00e1s lehet\u0151s\u00e9g\u00e9r\u0151l.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tov\u00e1bb\u00e1, a munkav\u00e1llal\u00f3 &#8211; a munkaviszony els\u0151 6 h\u00f3napj\u00e1t kiv\u00e9ve &#8211; k\u00e9rheti a munkav\u00e9gz\u00e9si hely \u00e9s a munkarend m\u00f3dos\u00edt\u00e1s\u00e1t, illetve a t\u00e1vmunkav\u00e9gz\u00e9s keret\u00e9ben vagy a r\u00e9szmunkaid\u0151ben val\u00f3 foglalkoztat\u00e1s\u00e1t, ha gondoz\u00e1st v\u00e9gez, vagy gyermeke \u00e9letkora nem \u00e9rte el a 8 \u00e9vet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A munkav\u00e1llal\u00f3 fenti k\u00e9relm\u00e9t \u00edr\u00e1sban indokolni k\u00f6teles, tov\u00e1bb\u00e1 abban meg kell jel\u00f6lnie a v\u00e1ltoztat\u00e1s id\u0151pontj\u00e1t. A k\u00e9relemre a munk\u00e1ltat\u00f3 15 napon bel\u00fcl \u00edr\u00e1sban k\u00f6teles nyilatkozni, \u00e9s ha elutas\u00edtja, akkor azt indokolnia kell. A k\u00e9relem jogellenes elutas\u00edt\u00e1sa vagy a nyilatkozat elmulaszt\u00e1sa eset\u00e9n a b\u00edr\u00f3s\u00e1g a munk\u00e1ltat\u00f3 hozz\u00e1j\u00e1rul\u00f3 nyilatkozat\u00e1t p\u00f3tolja.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A munk\u00e1ltat\u00f3nak a pr\u00f3baid\u0151 alatt (!), illetve a nyugd\u00edjasok \u00e9s a vezet\u0151 \u00e1ll\u00e1s\u00fa munkav\u00e1llal\u00f3k eset\u00e9ben is lesz indokol\u00e1si k\u00f6telezetts\u00e9ge egyes v\u00e9dett csoportokn\u00e1l. Nevezetesen: munk\u00e1ltat\u00f3 &#8211; a munkav\u00e1llal\u00f3 k\u00e9relm\u00e9re &#8211; indokol\u00e1si k\u00f6teless\u00e9g hi\u00e1ny\u00e1ban is megindokolja a munkaviszony megsz\u00fcntet\u00e9s\u00e9re ir\u00e1nyul\u00f3 jognyilatkozat\u00e1t, ha a munkav\u00e1llal\u00f3 hivatkoz\u00e1sa szerint a munkaviszony megsz\u00fcntet\u00e9s\u00e9re<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a gondoz\u00f3i munkaid\u0151-kedvezm\u00e9ny,<\/li>\n\n\n\n<li>az apas\u00e1gi szabads\u00e1g,<\/li>\n\n\n\n<li>a sz\u00fcl\u0151i szabads\u00e1g ig\u00e9nybev\u00e9tele,<\/li>\n\n\n\n<li>a gyermek gondoz\u00e1sa c\u00e9lj\u00e1b\u00f3l fizet\u00e9s n\u00e9lk\u00fcli szabads\u00e1g ig\u00e9nybev\u00e9tele,<\/li>\n\n\n\n<li>a rugalmas munkafelt\u00e9telek k\u00e9relmez\u00e9se,<\/li>\n\n\n\n<li>illetve a munkaszerz\u0151d\u00e9s m\u00f3dos\u00edt\u00e1s\u00e1ra ir\u00e1nyul\u00f3 k\u00e9relme<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">miatt ker\u00fclt sor. A munkav\u00e1llal\u00f3 a munk\u00e1ltat\u00f3 \u00e1ltal tett jognyilatkozat indokol\u00e1s\u00e1t annak k\u00f6zl\u00e9s\u00e9t\u0151l sz\u00e1m\u00edtott 15 napon bel\u00fcl \u00edr\u00e1sban k\u00e9rheti. A munk\u00e1ltat\u00f3 az indokol\u00e1st a k\u00e9relem k\u00e9zhezv\u00e9tel\u00e9t\u0151l sz\u00e1m\u00edtott 15 napon bel\u00fcl \u00edr\u00e1sban k\u00f6zli.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kib\u0151v\u00fclnek a felmond\u00e1si tilalmak az apas\u00e1gi szabads\u00e1g, a sz\u00fcl\u0151i szabads\u00e1g id\u0151tartam\u00e1val, illetve a s\u00falyos eg\u00e9szs\u00e9gi okb\u00f3l gondoz\u00e1sra szorul\u00f3 hozz\u00e1tartoz\u00f3, vagy a munkav\u00e1llal\u00f3val k\u00f6z\u00f6s h\u00e1ztart\u00e1sban \u00e9l\u0151 szem\u00e9lynek ny\u00fajtott szem\u00e9lyes gondoz\u00e1s c\u00e9lj\u00e1b\u00f3l ig\u00e9nybe vett szabads\u00e1g id\u0151tartam\u00e1val.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Munkaid\u0151keret kihirdet\u00e9sekor nem csup\u00e1n annak kezdet\u00e9t \u00e9s v\u00e9g\u00e9t, de a teljes\u00edtend\u0151 munkaid\u0151 tartam\u00e1t is k\u00f6zz\u00e9 kell tenni.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jogharmoniz\u00e1ci\u00f3 miatt pontos\u00edtott\u00e1k a fiatal (18 \u00e9v alatti) munkav\u00e1llal\u00f3kra \u00e9s v\u00e1rand\u00f3s, kisgyermekes (3 \u00e9v alatti) \u00e9s (4 \u00e9v alatti) gyermeket egyed\u00fcl nevel\u0151 munkav\u00e1llal\u00f3k eset\u00e9ben a munkaid\u0151re, a rendk\u00edv\u00fcli munkaid\u0151re \u00e9s \u00e9jszakai munkav\u00e9gz\u00e9sre vonatkoz\u00f3 korl\u00e1toz\u00e1sokat, tilalmakat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A szabads\u00e1gra val\u00f3 jogosults\u00e1g szempontj\u00e1b\u00f3l munk\u00e1ban t\u00f6lt\u00f6tt id\u0151nek min\u0151s\u00fcl az apas\u00e1gi szabads\u00e1g \u00e9s a sz\u00fcl\u0151i szabads\u00e1g, valamint a gondoz\u00f3i munkaid\u0151-kedvezm\u00e9ny tartama. Munk\u00e1ban t\u00f6lt\u00f6tt id\u0151nek min\u0151s\u00fcl a k\u00f6telezetts\u00e9gszeg\u00e9s k\u00f6r\u00fclm\u00e9nyeinek kivizsg\u00e1l\u00e1sa miatt indokolt, a vizsg\u00e1lat lefolytat\u00e1s\u00e1hoz sz\u00fcks\u00e9ges, legfeljebb harminc napra sz\u00f3l\u00f3 mentes\u00fcl\u00e9s tartama is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A munk\u00e1ltat\u00f3 a j\u00f6v\u0151ben kiv\u00e9telesen fontos gazdas\u00e1gi \u00e9rdek vagy a m\u0171k\u00f6d\u00e9s\u00e9t k\u00f6zvetlen\u00fcl \u00e9s s\u00falyosan \u00e9rint\u0151 ok eset\u00e9n a szabads\u00e1g kiad\u00e1s\u00e1t &#8211; az apas\u00e1gi szabads\u00e1got kiv\u00e9ve &#8211; legfeljebb 60 nappal elhalaszthatja. Ilyen esetben a munk\u00e1ltat\u00f3 az int\u00e9zked\u00e9s\u00e9t \u00edr\u00e1sban indokolni \u00e9s a kiad\u00e1s \u00e1ltala javasolt id\u0151pontj\u00e1t egyidej\u0171leg k\u00f6z\u00f6lni k\u00f6teles a munkav\u00e1llal\u00f3val.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hosszabb id\u0151tartam\u00fa lesz az apas\u00e1gi szabads\u00e1g \u00e9s \u00fan. sz\u00fcl\u0151i szabads\u00e1g is ig\u00e9nyelhet\u0151 lesz Nevezetesen: az ap\u00e1nak gyermek sz\u00fclet\u00e9se eset\u00e9n m\u00e1r nem 5, hanem 10 munkanap apas\u00e1gi szabads\u00e1g j\u00e1r, ennek 5 munkanapj\u00e1ra t\u00e1voll\u00e9ti d\u00edjra, a 6. munkanapj\u00e1t\u00f3l csak a t\u00e1voll\u00e9ti d\u00edj 40%-\u00e1ra jogosult. A munkav\u00e1llal\u00f3t &#8211; felt\u00e9ve, hogy a sz\u00fclet\u00e9st megel\u0151z\u0151 1 \u00e9ve fenn\u00e1ll a munkaviszonya &#8211; a gyermeke h\u00e1rom\u00e9ves kor\u00e1ig 44 munkanap sz\u00fcl\u0151i szabads\u00e1g illeti. A munkav\u00e1llal\u00f3 a sz\u00fcl\u0151i szabads\u00e1g tartam\u00e1ra csup\u00e1n a t\u00e1voll\u00e9ti d\u00edj 10%-\u00e1ra jogosult, amelyet cs\u00f6kkenteni kell az erre az id\u0151szakra a munkav\u00e1llal\u00f3nak megfizetett, a gyermekgondoz\u00e1si d\u00edj, illetve a gyermekgondoz\u00e1st seg\u00edt\u0151 ell\u00e1t\u00e1s \u00f6sszeg\u00e9vel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A munkaviszony megsz\u0171n\u00e9sekor az ig\u00e9nybe vett apas\u00e1gi szabads\u00e1g vagy sz\u00fcl\u0151i szabads\u00e1g tartam\u00e1ra vonatkoz\u00f3an is munk\u00e1ltat\u00f3i igazol\u00e1st kell adni.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A m\u00f3dos\u00edt\u00e1s a vezet\u0151 \u00e1ll\u00e1s\u00fa munkav\u00e1llal\u00f3k eset\u00e9n is el\u0151\u00edrja, hogy nem lehet elt\u00e9rni a bevezetett gondoz\u00f3i munkaid\u0151-kedvezm\u00e9ny, apas\u00e1gi szabads\u00e1g \u00e9s a sz\u00fcl\u0151i szabads\u00e1g rendelkez\u00e9seit\u0151l.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A m\u00f3dos\u00edt\u00e1s pontos\u00edtja, hogy a meg\u0151rz\u00e9sre \u00e1tvett dolog megrong\u00e1l\u00f3d\u00e1sa miatt keletkezett k\u00e1r\u00e9rt fenn\u00e1ll\u00f3 munkav\u00e1llal\u00f3i felel\u0151ss\u00e9gre a felel\u0151ss\u00e9g \u00e1ltal\u00e1nos szab\u00e1lyait kell alkalmazni: sz\u00e1nd\u00e9kos vagy s\u00falyosan gondatlan k\u00e1rokoz\u00e1s eset\u00e9n teljesk\u00f6r\u0171 a felel\u0151ss\u00e9g, m\u00edg egy\u00e9b esetben a limit 4 havi t\u00e1voll\u00e9ti d\u00edj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00f3dosulnak a pr\u00f3baid\u0151 szab\u00e1lyai a hat\u00e1rozott idej\u0171 munkaviszonyn\u00e1l is. A legfeljebb 12 h\u00f3napra l\u00e9tes\u00edtett hat\u00e1rozott idej\u0171 munkaviszony eset\u00e9ben csak id\u0151ar\u00e1nyos (!) pr\u00f3baid\u0151 k\u00f6thet\u0151 ki.
